Terms and Conditions

• Order minimum is $50.00, we suggest that you group orders to meet minimum.
• Color Bar is sold by kilos. Bars are cut to closely match the kilos ordered. Total kilos that are actually shipped will be adjusted upon filling your order. Total charged will reflect this adjustment.
•Prices are subject to change without notice.
• Orders must be paid in advance of shipping, unless otherwise arranged.
• Please, feel free to call and confirm your order with our staff.
• All products may not be available when ordered. Items not available will be back ordered. We will call you when items are available and ready to ship.
• Sales tax will be applied to all orders shipped within California, unless a resale license has been submitted.
• We retain the right to refuse sales to delinquent or under used accounts.

• East Bay Color and East Bay Batch are not responsible for any damages to persons or property resulting from the use of any or all technical information and/or merchandise provided by East Bay Color or East Bay Batch.


PAYMENT METHODS
We accept cash, VISA, MasterCard, American Express, personal or company checks for your purchases. There is a $20.00 fee for all returned checks.

ACCOUNTS
We have 'Net 30 day' accounts available for customers ordering more than $1200 of glass per year. If you think you will be needing this type of account, please submit the following information:
• Name of the owner and authorized buyers
• Business or institution name.
• Bank account information
• Three vendors credit references
• And all invoicing requirements that your institution requires for payment.
If your sales do not meet the yearly minimum, or if your account is consistently past due, your account will revert to credit card terms. Please note: All outstanding invoices will incur a 2.25% interest late fee.

SHIPPING
Orders will be shipped via UPS or USPS. Orders will be sent ground, unless otherwise arranged. Next day, 2nd day or 3rd day services are available for additional fees. Please note: UPS charges residential fees for all home business delivery.  Please inform East Bay of any "Special Shipping Instructions" to insure proper delivery of your order; East Bay will not be responsible for lost shipments do to incorrect shipping instructions or addresses.  East Bay is not responsible for damaged, lost or stolen packages after they leave our warehouse. Call us for any additional shipping information and prices.



DELIVERY
Please carefully inspect all merchandise upon receipt. If you are not sure of the condition of the goods, write “Suspect damage” on the delivery receipt. File all claims WITH THE CARRIER AT ONCE. KEEP ALL PACKING MATERIALS, MERCHANDISE, etc. for the carrier’s inspection. Please read “Damages” section.

RESALE
California businesses will be charged sales tax until we have a completed California Resale Certificate with a valid California Resale Number on file. If your business is located in California, download the California Resale Certificate from us to mail and fax back to us to verify you have a valid California Resale Number. Please note: only businesses residing in California need to submit a California Resale Certificate. Sales tax is not added to invoices when orders are shipped outside of California.



EXCHANGES & RETURNS
If defective or incorrect merchandise has been shipped to you through our error, please notify us within 5 days from receipt of merchandise. We will exchange defective or incorrect merchandise without additional shipping charges. Items must be unused, in their original container and accompanied by all pages of the original invoices. Please include a written description stating the problem. All exchanges must be authorized by an East Bay customer service representative.

All orders returned for anything other than defective merchandise will be assessed a 15% restocking fee. No returns will be accepted after 60 days of invoicing.

Please note: no returns on old stock, overstock or sale purchases.

DAMAGES
We are not liable for damages or loss of merchandise once it has left our warehouse. If shipment shows outward evidence of damage, note it on the bill of laiding or open it before signing the delivery receipt. File a claim immediately with the carrier and notify us. Keep all packaging for the carriers inspection. DO NOT return anything to us without our authorization.
